San Diego Traffic Violations and Infractions
Almost all California traffic citations are considered “infractions” under California Law. An infraction is an offense that is considered less serious than even a misdemeanor. Common California Infractions include Speeding, Running a Red Light, and Driving on a Suspended License. While a person may not end up in jail if they are found guilty of an infraction, they are often shocked at how expensive the penalties can be. In California, it is not unusual for a person to accrue over $1000 in fines from a run-of-the-mill traffic stop. This is because California has enacted various penalties and assessments in addition to the statutory fines for these very minor offenses. If a person ignores their requirement to appear in court or pay their fine on the date written on their citation, they can face license suspensions and additional fines of $300 or more. Ignoring a traffic citation also appears on your record as “Failure to Appear” (FTA), which potentially could have an effect on a court’s view of your responsibility or credibility in a future proceeding.
Even though infractions are the least serious California “crime,” an individual charged with an infraction is afforded Due Process rights, in accordance with California Criminal Procedure. There are some minor differences, such as the direct prosecution of the accused by law enforcement, the absence of a right to a public defender, and the absence of a right to be tried by an empaneled jury. Additionally, your case may be heard by a Commissioner instead of a Judge.
