San Diego Traffic Violations and Infractions

Almost all California traffic citations are considered “infractions” under California Law.  An infraction is an offense that is considered less serious than even a misdemeanor.  Common California Infractions include Speeding, Running a Red Light, and Driving on a Suspended License.  While a person may not end up in jail if they are found guilty of an infraction, they are often shocked at how expensive the penalties can be.  In California, it is not unusual for a person to accrue over $1000 in fines from a run-of-the-mill traffic stop.  This is because California has enacted various penalties and assessments in addition to the statutory fines for these very minor offenses.  If a person ignores their requirement to appear in court or pay their fine on the date written on their citation, they can face license suspensions and additional fines of $300 or more.  Ignoring a traffic citation also appears on your record as “Failure to Appear” (FTA), which potentially could have an effect on a court’s view of your responsibility or credibility in a future proceeding.

Even though infractions are the least serious California “crime,” an individual charged with an infraction is afforded Due Process rights, in accordance with California Criminal Procedure.  There are some minor differences, such as the direct prosecution of the accused by law enforcement, the absence of a right to a public defender, and the absence of a right to be tried by an empaneled jury.  Additionally, your case may be heard by a Commissioner instead of a Judge.

The Law Office of Sammer A. Zakhour charge a flat rate of $250 for all non-alcohol related infractions (see here for DUI charges).  The process is simple:  provide the firm with a copy of your citation and a paragraph or two summarizing your account of the incident.  The attorneys at the firm will handle the entire case from that point on, without you having to pay any money again unless you are found guilty after a contested hearing.  The Attorneys at the Law Office of Sammer A. Zakhour have prevailed in numerous contested infraction hearings in all of the San Diego County Courthouses.  Many people simply hope the citing Police Officer does not show up.  Even when the Officer does attend the Court Hearing, there are numerous legal maneuvers that can be performed to result in the dismissal of your case, or alternatively, a drastic reduction in your fines, as well a limited impact on your DMV record (as well as your Car Insurance Premium).

  • Defense lawyer

Thank you!! I am grateful to have a lawyer who takes the time out of his day, even a day before his birthday to meet with me, text me updates throughout the day and make sure I understand everything that is happening. I had a great experience working with Sam, and the case is now behind us and I can go on with my life, free.

  • Incredibly helpful, thoughtful and thorough

Overall, Sammer was professional, caring, communicative, and extremely hard-working. The very first day I called Sammer about attaining a restraining order, I was waiting for police to arrive at my home. He left work immediately to meet up with me on location and get all the details of the case. Throughout the legal process, he was available, timely, made the entire process easy and clear, and gave safety advice above and beyond legal matters.
